Recently, the Market Supervision Administration of Jiujiang City, Jiangxi Province, at the request of MingDun, imposed a fine of CNY 120,000 on the Jiujiang Fuzeyuan Pharmacy for its retail of only 3 boxes of medicines purchased through illegal channels. This case was published as a typical case by Jiangxi Provincial Market Supervision Administration. Details of the case are as follows.
In October 2022, MingDun found that the client’s products sold by the Fuzeyuan Pharmacy had actually flowed through the Affiliated Hospital of Jiujiang Medical College. In another word, the client’s products should be at the hand of the patients, and the Fuzeyuan Pharmacy should have purchased the client’s products from illegal channels. The Fuzeyuan Pharmacy should be retailing Diverted Medicine.
Under normal circumstances, the medicine should be stored in a dry and closed environment. When the medicine goes into the control of the patient, it is obvious that the medicine could not be transported and stored under the prescribed conditions, which is easy to cause the deterioration or failure of the drug. The diverted medicine does not conform to the drug quality management standards, which can easily bring certain safety risks to users.
To protect the medical safety of the public and safeguard the legitimate rights and interests of the client, MingDun immediately reported the situation to the Market Supervision Administration of Jiujiang City, Jiangxi Province. The officials accepted our complaint and inspected Fuzeyuan Pharmacy. In the course of the law enforcement inspection, the officials checked the purchase documents of Fuzeyuan Pharmacy but failed to find the legal bills for the purchase of our client's products. Moreover, the Fuzeyuan Pharmacy did not issue sales vouchers for medicines in accordance with the provisions of the > when it sold the aforementioned drugs.
After a comprehensive investigation, the Jiujiang Market Supervision Administration made an administrative punishment decision at the beginning of 2023 on the Jiujiang Fuzeyuan Pharmacy, confiscating the illegal income of CNY126 (the sales volume of 3 boxes of medicine), and imposing a fine of CNY120,000 (2.4 times the value of the goods which is calculated by CNY 50,000 when the value is less than CNY 50,000)
Once again, MingDun successfully protected the client's legitimate rights and interests, and safeguarded the drug safety and public health.
