Yingying Zhu focuses her practice on IP related matters. Before joining Mingdun, Yingying Zhu worked for a US global law firm and headed its trademark practice in China for about 10 years.

 

Ms. Zhu advises many multinationals on IP protection work encompassing contentious and non-contentious matters, including trademark prosecution, copyright and domain name registration, IP strategy, IP portfolio management, IP due diligence, negotiation for IP-related disputes, assignment and licensing of IP rights, anti-counterfeiting, data privacy and cybersecurity, IP infringement civil litigation and administrative lawsuits.

 

Ms. Zhu has successfully represented/advised some of the world’s most famous brand names before various Chinese courts including the China Supreme Court.


SIGNIFICANT REPRESENTATION:


IP TRANSITIONAL MATTERS:

Advised an international organization on the implementation of copyright legislation in China;

Advised a top Chinese university on its copyright assignment and protection policy;

Advised an American multinational business magazine on online copyright protection strategy and dealt with infringement issues with other similar online platforms of content providers;

Advised a US e-commerce website for handicrafts on copyright infringement issues related to the design and sale of products with original authorship;

Advised a French luxury, sport and lifestyle brands holding company on its acquisition of a Chinese fine-jewellery maker;

Advised a French biotechnology company on its patent licensing agreement with a Chinese entity;

Advised an Italian luxury brand on its negotiation and acquisition of IP assets from various parties in China;

Advised a French luxury, sport and lifestyle brands holding company on its negotiation and acquisition of IP assets from a third party in China;

Advised a Belgium-based high-technology engineering consulting group on its international corporate, IP and transactional due diligence matters.


DATA PRIVACY AND CYBERSECURITY MATTERS:

Advised a US e-commerce website on data breach investigations, responses and remedies related to cybersecurity and data privacy;

Advised an American multinational business magazine on its user contract and data privacy policy related to software application on mobile device;

Advised a French leading platform for benchmarking, innovation and reverse engineering on its service agreement and data privacy notice related to data provision and sharing services;

Advised a French biotechnology company on the compliance of its data privacy policy with the relevant Chinese laws and regulations;

Advised a US software company on the review and update of its consumer contract with regard to licensed software and SaaS services for compliance with existing and emerging international and domestic regulatory requirements;

Advised an Australian global charity group on the contractual issues related to the sharing of data and programs with digital distributors in China during the Covid-19 global charity show.


CIVIL LAWSUITS:

Represented a US digital giant in a trademark infringement and unfair competition civil lawsuit before the Chinese court. This case was listed as one of the Top 50 Typical IP cases of the year in China by the China Supreme Court (winning);

Represented a US global leader for plumbing products in a trademark infringement and unfair competition civil lawsuit before the Chinese court. This case was listed as one of the Top 50 Typical IP cases of the year in China by the China Supreme Court (winning);

Represented a US fire insurance company in a copyright infringement civil lawsuit before the Chinese court (winning);

Represented a US banking company in two instances of trade name infringement civil lawsuit before the Chinese courts (winning);

Represented a US multinational company in a trademark infringement and unfair competition civil action before the Chinese courts (winning);

Represented an international auto racing group in a trademark infringement and unfair competition civil action before the Chinese court (settled);

Advised a French medical instrument company (defendant) in the trademark infringement lawsuit before the Chinese court (withdrawn by plaintiff);

Advised an Italian luxury brand in two instances of trademark infringement and unfair competition lawsuit and the retrial proceeding before three levels of Chinese courts including the China Supreme Court (settled).


ADMINISTRATIVE LAWSUITS:

Represented a Japanese fashion house in two instances of trademark administrative lawsuit before the Chinese courts. This case was listed as one of the four notable IP cases of the year in China by Asia IP (winning);

Advised an Italian luxury brand in four administrative complaints lodged before local IP Bureau regarding design patent infringement (infringement confirmed);

Advised a French furniture chain-store company in two instances of trademark administrative lawsuit before the Chinese courts (winning);

Advised a French medical instrument company in the trademark administrative retrial before the China Supreme Court (retrial approved);

Advised a French luxury brand in two instances of trademark administrative lawsuit and the retrial proceeding before three levels of Chinese courts including the China Supreme Court (winning);

Advised a French luxury & life style group in two instances of trademark administrative lawsuit and the retrial proceeding before three levels of Chinese courts including the China Supreme Court (retrial approved and winning).
